With the publication of Law No. 6715, "The Law on Amending the Turkish Employment Agency Law," the scope of services provided by Private Employment Agencies authorized by the Turkish Employment Agency was expanded, and the authority to establish temporary employment relationships was granted to these agencies.

Employers can establish temporary employment relationships only through private employment agencies authorized by the Turkish Employment Agency.

Situations Where Temporary Employment Can Be Provided

Maternity

  • During the pre- and postnatal leave period
  • During the part-time working period after maternity leave
  • During the reduced working period after maternity leave
  • During the unpaid leave period after birth

Suspension of Employment Contract

  • During military service
  • During unpaid leave
  • During sick leave
  • Other suspension cases mandated by law

Cases Where Temporary Workers Can Be Supplied Without Time Limit

  • Domestic services
  • Seasonal agricultural work

Cases Where Temporary Workers Can Be Supplied for a Limited Time

  • In case of seasonal increases in workload
  • When personnel is needed for temporary projects
  • In case of unforeseen disruptions affecting production
  • If the production capacity of the enterprise increases unpredictably – the number of temporary workers must not exceed ¼ of the total workforce at the workplace!

Situations Where Temporary Employment Cannot Be Provided

Permanently

  • In public institutions and organizations
  • In workplaces where underground mining is conducted
  • During periods of strikes and lockouts

Temporarily

  • For the same job within 6 months
  • For a dismissed worker within 6 months of termination
  • Within 8 months following the date of mass layoffs
